DMCA Policy

ShiftCare Pro respects the intellectual property rights of others and expects users of the Service to do the same. In accordance with the Digital Millennium Copyright Act, 17 U.S.C. § 512 ("DMCA"), and equivalent copyright laws in other jurisdictions, we will respond promptly to valid notices of alleged copyright infringement involving content hosted on the Service.
1. Reporting copyright infringement
If you believe that content available on or through the Service infringes your copyright, please send a written takedown notice to our designated copyright agent containing all of the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
- Identification of the copyrighted work claimed to have been infringed (or, if multiple works are covered by one notice, a representative list of those works);
- Identification of the material claimed to be infringing, with enough detail for us to locate it (for example, a URL or a description of where it appears in the Service);
- Your contact information, including your name, mailing address, telephone number, and email address;
- A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

Please note that under 17 U.S.C. § 512(f), you may be liable for damages, including costs and attorneys' fees, if you knowingly and materially misrepresent that material is infringing. If you are unsure whether content infringes your copyright, consider consulting an attorney before submitting a notice.
2. What happens when we receive a notice
When we receive a valid takedown notice, we will:
- Remove or disable access to the allegedly infringing material promptly;
- Make a reasonable effort to notify the user who posted the material, including providing them a copy of the notice;
- Record the notice for our repeat-infringer tracking.
3. Counter-notification
If you believe material you posted was removed or disabled by mistake or misidentification, you may submit a written counter-notification to our copyright agent containing:
- Your physical or electronic signature;
- Identification of the material that was removed or disabled and the location where it appeared before removal;
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification;
- Your name, mailing address, and telephone number, and a statement that you consent to the jurisdiction of the courts in your district (or, if outside the United States, any judicial district in which ShiftCare Pro may be found), and that you will accept service of process from the person who filed the original notice or their agent.
If we receive a valid counter-notification, we will forward it to the original complainant. Unless the complainant notifies us within ten (10) business days that they have filed a court action seeking to restrain the alleged infringement, we may restore the removed material within ten (10) to fourteen (14) business days of receiving the counter-notification.
4. Repeat infringers
We maintain a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat infringers. We may also, at our discretion, limit access to the Service for any user who infringes the intellectual property rights of others, whether or not there is repeat infringement.
5. Other intellectual property concerns
If you believe content on the Service infringes intellectual property rights other than copyright (for example, a trademark), contact us at legal@shiftcarepro.com with a description of the issue and the location of the material, and we will review the matter.
